
While the V2 SAPA agreement is a valuable tool, it does not replace the expertise of a solicitor. While not mandatory for purchasing a mobile home in Spain, a solicitor can provide guidance if a purchaser has reasons to be concerned about the property they are about to buy.
The V2 SAPA Agreement between the purchaser and vendor is to give the purchaser some assurances that a) The vendor is the legal owner of the home, b) The vendor has the right to sell the home in the park, c) The vendor has settled all outstanding debts to the park and d) What is for sale is defined in the agreement and should legal action be required at a later date each party has documented proof.
For added security, the purchaser and vendor will share the same licence number on the watermarked documents, ensuring the transaction’s authenticity.
With the terms and conditions of the sale recorded within the V2 SAPA, it is incumbent on the purchaser to check that everything declared as included in the sale is present and that vacant possession is assured before transferring the final payment.
Cash transactions are STRONGLY not recommended. Use bank transfers only.
The purchaser should not proceed to the final payment stage unless in possession of scanned copies of all signed agreements from the vendor in both English and Spanish.
The original documents will remain in trust with Buy Or Sell Mobile Homes/ Costa Difference/ Martin Theobald X6110415M for a year.
The V2 SAPA is a cost-effective way to set out the terms of sale and have some basic safeguards in place. Genuine vendors will welcome the use of a SAPA agreement.
If a vendor refuses to use a SAPA agreement to conduct the sale, we strongly recommend that a solicitor be employed instead.
The costs involved in conducting the terms of sale/purchase using a V2 SAPA agreement can never be a reason for not providing a purchaser with basic assurances. A single-sale licence for the SAPA V2 agreement service costs only £125 or 140€ per party.
The park the home is on must sign to say the sale can take place and no debts are associated with the home. Checks will be made directly with the park to ensure the signature and stamp are genuine before the purchaser receives the vendor’s signed V2 SAPA agreements to confirm they can complete their purchase.
